Labor and Employment

 

An important part of the firm's practice has historically been representing labor organizations and employees.This includes issues such as organizing and representation drives, elections, negotiation of collective bargaining agreements, advice on handling grievances and representation at arbitrations, enforcing labor contracts. We also advise Unions in all aspects of labor laws, and represent Unions in litigation in State and Federal courts on all issues, ranging from job actions, to strikes, to fair representation cases.

 

For individuals, our attorneys bring decades of experience handling discrimination matters, fair labor standards disputes, severance and termination agreements, restrictive covenants, pension benefits, whistleblower and CEPA cases, breach of written and implied contracts, as well as family leave, disability, and wrongful terminations.

 

For employers, we have, in non-union settings, prepared personnel manuals and handbooks, and handled immigration, FLSA, and discrimination matters before governmental agencies and in courts. In addition, we have represented these employers in various other areas such as partnership agreements, restrictive covenants and contract disputes.

 

Though we seek to avoid costly and time-consuming trials, we are always ready to represent our clients in both bench and jury trials on nearly all of the foregoing areas, as well as hearings before administrative agencies.
