Mr. Nowak practices in a wide variety of litigation, including all aspects of labor and employment law, bankruptcy, receiverships, ERISA, as well as general litigation. Mr. Nowak handled the seminal United States Supreme Court case of Bildisco v. Local 408 Pension Fund on behalf of the Pension Fund, a case which resulted in Federal bankruptcy legislation. He has also tried numerous jury and bench cases in Federal and State courts on behalf of plaintiffs and employers. He has also served as counsel to creditors' committees in bankruptcy matters, counsel to receivers in fraud schemes, and has been a government-appointed receiver. Mr. Nowak also represents numerous private and public sector unions in all aspects, including advice, collective bargaining, arbitrations, unfair labor practice charges, and litigation. He also represents various ERISA pension and welfare funds. Mr. Nowak has also represented companies, though not in union matters, regarding employment issues, such as discrimination cases, restrictive covenants, FLSA, CEPA, severance agreements, and employee manuals. Mr. Nowak is also special counsel to municipalities.
He served as Deputy Attorney General from 1977 to 1981. He has lectured at various seminars on labor and bankruptcy issues. Mr. Nowak was also a member of the New Jersey Supreme Court's Civil Practice Committee.
