Election Law

The Firm has successfully prosecuted and defended election cases in state and federal trial courts, the Office of Administrative Law, the Appellate Division and the State Supreme Court, based on our extensive knowledge of substantive election law and procedure. We have the ability to represent our clients even when the dispute, like many election cases, proceeds on a highly accelerated basis, over the course of just a few days or weeks.

Among other matters, the Firm is counsel to a civic organization that successfully obtained a statewide injunction expanding the eligibility of New Jerseyans to circulate nominating and recall petitions, under the Federal and State Constitutions. We have represented both advocates and opponents of local initiative and referendum questions, as well as candidates, in ballot access litigation, recounts, and in election contests. The Firm has also represented voters in litigation over the eligibility of candidates to run for office. And, we have also represented political organization factions in internal governance disputes.
